Nourished by Nature – Clinical Nutrition, Naturopathic & Health Assessment Services

These Terms and Conditions ("Terms") govern your use of Nourished by Nature's clinical nutrition, naturopathic, health assessment, consultation, and laboratory testing services ("Services"). By purchasing, booking, ordering, accessing, or using any Nourished by Nature Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

 

1. Definitions

Nourished by Nature ("We", "Us", "Our") means Nourished by Nature.

Customer ("You", "Your") means the individual purchasing or using Nourished by Nature Services.

Services means clinical nutrition consultations, naturopathic consultations, laboratory testing, health assessments, reports, educational materials, wellness support, and related services provided by Nourished by Nature.

Results means the findings, reports, reference information, educational commentary, recommendations, and interpretive data generated by Nourished by Nature or its partner laboratories.

 

2. Eligibility

2.1 You must be at least 18 years of age to purchase Services, or have the consent of a parent or legal guardian.

2.2 By booking or ordering a Service, you confirm that the information you provide is accurate and complete to the best of your knowledge.

2.3 Nourished by Nature reserves the right to refuse, suspend, or cancel any Service where misuse, fraudulent activity, abusive behaviour, or inappropriate conduct is suspected.

 

3. Scope of Services

3.1 Nourished by Nature provides clinical nutrition consultations, naturopathic consultations, functional health assessments, laboratory testing, educational resources, and wellness support services.

3.2 Services are intended to support nutritional, lifestyle, and wellness decision-making and may include individualised recommendations based on information provided by the Customer.

3.3 Nourished by Nature practitioners may provide nutritional, dietary, lifestyle, and naturopathic guidance within their professional training and scope of practice.

3.4 Services provided by Nourished by Nature are complementary health services and are not a substitute for medical diagnosis, emergency care, or treatment provided by a registered medical practitioner.

3.5 Customers should seek advice from an appropriate healthcare professional regarding any medical concerns, symptoms, diagnoses, medications, or treatment decisions.

3.6 Specific Testing Disclaimer

Where Nourished by Nature provides food sensitivity, food intolerance, hair analysis, bioresonance, toxicity, nutritional, wellness, or other functional health assessments, these Services are intended to provide educational, nutritional, and wellness-related information only.

These Services are not medical diagnostic tests and are not intended to diagnose, treat, cure, monitor, or prevent any disease, medical condition, allergy, nutritional deficiency, toxicity, or health disorder.

Food sensitivity or intolerance testing offered by Nourished by Nature is not an allergy test and must not be used to diagnose, confirm, or exclude food allergies. Customers who suspect a food allergy or experience allergic reactions should seek advice from a registered medical practitioner or appropriate healthcare professional.

Results should be considered alongside an individual's health history, symptoms, clinical assessment, and professional healthcare advice and should not be relied upon as the sole basis for medical, dietary, or treatment decisions.

 

4. Customer Responsibilities

4.1 You agree to:

• Provide accurate and complete personal and health information.

• Inform us of any relevant medical conditions, medications, or health concerns.

• Consult an appropriate healthcare professional regarding any medical concerns.

• Use Results and recommendations as one source of information only and not as the sole basis for health or medical decisions.

4.2 You acknowledge that no assessment, consultation, or test is 100% accurate and that Results should be interpreted alongside other relevant health information.

4.3 You are responsible for informing your medical practitioner of any significant symptoms, health concerns, or changes in your condition.

 

5. Informed Consent

5.1 By booking, purchasing, or ordering a Service, you acknowledge and agree that:

• You understand the nature and purpose of the consultation, assessment, or testing being performed.

• You understand the limitations of the Services and information provided.

• You understand that results may not identify all contributing factors to your health concerns.

• You understand that recommendations are provided to support health and wellbeing and are not intended to replace medical care.

• You voluntarily consent to the collection, analysis, and processing of your personal information and any samples submitted for testing.

5.2 You may withdraw consent prior to testing or consultation services commencing. Refunds will be provided where required by the Consumer Guarantees Act 1993 or other applicable New Zealand law.

 

6. Privacy & Data Protection

6.1 Nourished by Nature is committed to protecting your privacy and handling personal information in accordance with the New Zealand Privacy Act 2020.

6.2 By using our Services, you consent to the collection, storage, processing, and sharing of your information with laboratories, healthcare service providers, and contractors where necessary to provide the Services.

6.3 Nourished by Nature will take reasonable steps to protect your personal information from unauthorised access, disclosure, or misuse.

7. Orders, Samples & Turnaround Times

7.1 Orders are processed upon receipt of payment unless otherwise agreed.

7.2 Customers are responsible for ensuring samples are collected, stored, and submitted in accordance with the instructions provided.

7.3 Failure to follow collection instructions may result in inaccurate Results, delays, or the need for repeat testing.

7.4 Turnaround times are estimates only and may vary due to laboratory processing, courier services, public holidays, supplier delays, or factors beyond our reasonable control.

 

8. Results, Recommendations & Interpretation

8.1 Results, reports, and assessments will be provided directly to the Customer unless otherwise arranged.

8.2 Nourished by Nature may provide educational commentary, nutritional recommendations, naturopathic guidance, supplement recommendations, lifestyle advice, reference ranges, and general wellness information to assist understanding of Results.

8.3 Recommendations provided by Nourished by Nature are based on information available at the time of consultation or assessment and are intended to support overall health and wellbeing.

8.4 Results, reports, and recommendations should not be relied upon as medical advice and should not replace consultation with a registered healthcare professional where medical assessment or treatment is required.

8.5 Nourished by Nature does not guarantee any specific health outcome arising from consultations, recommendations, testing services, supplements, dietary changes, or lifestyle interventions.

8.6 Customers remain responsible for decisions regarding their healthcare, treatment, dietary choices, and use of supplements or other products.

 

9. Fees, Payments & Refunds

9.1 All prices are displayed in New Zealand Dollars (NZD) and include GST unless otherwise stated.

9.2 Payment must be made at the time of consultations, testing, or other Services are provided unless otherwise agreed.

9.3 Refunds may be available where required by the Consumer Guarantees Act 1993 or other applicable New Zealand law.

9.4 Once a consultation has been provided, a test kit has been dispatched, or laboratory processing has commenced, refunds may not be available except where required by law.

9.5 Nourished by Nature reserves the right to amend pricing at any time.

 

10. Intellectual Property

10.1 All reports, content, materials, trademarks, branding, educational resources, and intellectual property provided by Nourished by Nature remain the property of Nourished by Nature.

10.2 Customers may use reports and materials for personal use only.

10.3 No content may be copied, reproduced, distributed, modified, published, or resold without prior written permission from Nourished by Nature.

 

11. Limitation of Liability

11.1 Nothing in these Terms limits or excludes any rights that cannot be excluded under New Zealand consumer law.

11.2 To the maximum extent permitted by law, Nourished by Nature shall not be liable for:

• Decisions made by Customers based on Results or recommendations.

• Any indirect, incidental, special, or consequential loss or damage.

• Delays caused by laboratories, couriers, suppliers, or events outside our reasonable control.

• Outcomes arising from a Customer's failure to disclose relevant information or follow recommendations appropriately.

11.3 Where liability cannot be excluded, Nourished by Nature's liability shall be limited to the amount paid for the specific Service giving rise to the claim.

 

12. Cancellation & Suspension

12.1 Nourished by Nature reserves the right to refuse, suspend, or cancel Services where:

• These Terms are breached.

• Fraudulent or unlawful activity is suspected.

• Required information or samples are not provided.

• Abusive, threatening, or inappropriate behaviour occurs.

12.2 Any outstanding fees remain payable.

 

13. Amendments

Nourished by Nature may update these Terms from time to time. Updated Terms will be published on our website and will apply to future purchases, bookings, and Services.

 

14. Governing Law

These Terms are governed by the laws of New Zealand. Any dispute arising from these Terms shall be subject to the jurisdiction of the courts of New Zealand.
